Immigration judges granted a convicted child sex offender the right to enter Britain, ruling that barring him would breach his human rights. This decision, described as “deeply perverse,” allowed Jamaican paedophile Oniel Spence, jailed in the US for a sexual offence against a 15-year-old, to appeal his exclusion.
The case involves Oniel Spence, 43, who sought to enter the UK in 2023 to join his British wife and child. Despite the Home Office blocking his application on grounds of public good, junior immigration tribunals repeatedly sided with Spence, citing Article 8 of the European Convention on Human Rights (ECHR).
The Shocking Tribunal Decisions
Oniel Spence, a Jamaican national, was convicted in 2008 in the United States for “lewd and lascivious conduct with a victim aged under 16.” This offence occurred in a Florida nightclub when Spence was 25 years old. He served half of a three-year sentence before being deported to Jamaica.
Spence applied to come to the UK in 2023. The Home Office initially blocked his entry, deeming his exclusion “conducive to the public good.” However, Spence appealed this decision.
Judges Overrule Home Office on “Human Rights”
“The fact that he is primarily attracted to adults must mean that the first-tier tribunal considered that he has, at least, a residual or secondary sexual attraction to children.”
— Lord Justice Lewis, Court of Appeal
Immigration judge Jonathan Greer at the lower tribunal granted Spence permission to enter, citing Article 8 of the ECHR, which covers the right to ‘private and family life’. This decision was upheld by judges Madeleine Reeds and Nathan Moxon at the upper immigration tribunal, despite an appeal from then Home Secretary Yvette Cooper.
Key Facts Exposed:
- Immigration judges granted a convicted child sex offender the right to enter Britain.
- Oniel Spence was jailed in the US for a sexual offence against a 15-year-old girl.
- His lawyers argued preventing his entry breached Article 8 of the ECHR.
- Junior judges allowed his appeal despite his “residual or secondary sexual attraction to children.”
- The Court of Appeal recently overturned the decision, calling it “perverse,” but ordered a re-hearing, meaning Spence could still win.
What This Means for Britain
This ruling exposes a deeply flawed system that prioritises the “human rights” of convicted paedophiles over the safety and security of British families. Your children, your neighbours, and your community are put at risk when such individuals are allowed to enter the country under the guise of family life. It is a betrayal of common sense and public trust.
Economically, the endless legal appeals and re-hearings tied to such cases drain taxpayer money that could be spent on vital public services. This is a cost Britain can ill afford, especially when the nation faces pressing economic challenges.
Politically, this incident highlights a pattern of judicial overreach and a failure of the establishment to protect its citizens. Shadow Home Secretary Chris Philp described the initial ruling as “deeply perverse,” underscoring the growing frustration with a system that appears detached from the realities faced by ordinary Britons.
If this continues, Britain risks becoming a haven for those who exploit our legal system, undermining the very fabric of our society. This is not merely a legal technicality; it is a fundamental question of who our laws are designed to protect.
